User Agreement

This Service Agreement ("Agreement") is by and between "Report a Bully" and you and your heirs, assigns, agents and contractors (collectively, "You") and is effective as of the date of electronic execution. This Agreement sets forth the terms and conditions of Your use of the "Report a Bully" Web Site service and represents the entire agreement between You and "Report a Bully" in connection with the subject matter of this Agreement. By using "Report a Bully" services, You acknowledge and agree that You have read, understand and agree to be bound by all the terms and conditions of this Agreement, along with any new, different or additional terms, conditions or policies, including, but not limited to, the Universal Terms of Service, which "Report a Bully" may establish from time to time. Such Agreements may be found here. In addition to transactions entered into by You on Your behalf, You also agree to be bound by the terms of this Agreement for transactions entered into on Your behalf by anyone acting as Your agent, and transactions entered into by anyone who uses the account. You further acknowledge and agree that as adequate consideration for Report a Bully providing You with the Services at no cost to You, Report a Bully shall have the right to place certain advertisements on the web site and in generated emails. Subject to the terms and conditions of this Agreement, Report a Bully shall attempt to provide services on a twenty-four (24) hours a day, seven (7) days a week basis throughout the term of this Agreement. You acknowledge and agree that from time to time the service may be inaccessible or inoperable for any reason, including, without limitation: (i) equipment malfunctions; (ii) periodic maintenance procedures or repairs that Report a Bully may undertake from time to time; or (iii) causes beyond the control of Report a Bully or that are not reasonably foreseeable by Report a Bully , including, without limitation, interruption or failure of telecommunication or digital transmission links, hostile network attacks network congestion or other failures. You acknowledge and agree that Report a Bully has no control of availability of Hosting services on a continuous or uninterrupted basis. Report a Bully is provided on an "as is" basis and without warranty or guarantee of any kind, either express or implied, including but not limited to, the implied warranties or conditions of merchantability or fitness for a particular purpose. In no event shall Report a Bully be liable for any loss of data, interruption of service, or for indirect, special, or consequential damages of any kind, even if Report a Bully has been advised of the possibility of such damages arising from any defect or error in the Application. You shall indemnify, defend by counsel reasonably acceptable to Report a Bully , protect and hold Report a Bully harmless from and against any and all claims, liabilities, losses, costs, damages, expense, including consultants` and attorneys` fees and court costs, demands, causes of action, or judgments directly or indirectly arising out of or related to Your use of the service.
